1. About us

This website is owned and provided by Des Gosling Mobility Limited. The Company is incorporated in England and Wales under company number 4035607. Our VAT Number is 598694454.

These terms and conditions apply only to the use of this online shop website and by accessing this online shop website and/or placing an order you agree to be bound by the terms and conditions set out here. If you do not agree to be bound by these terms and conditions, you may not use or access this online shop website.

2. The Contract Between Us

Any contract for purchases made through the online shop website will be with Des Gosling Mobility Limited. We must receive payment of the whole of the price for the goods that you order before your order can be accepted, and the contract formed.

Once payment has been received we will confirm that your order has been received by sending an email to you at the email address you provide in your registration form. The shipment email will include your name, the order number and the total price. Our acceptance of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract.

We are entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our online shop website. If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered, we will contact you as soon as possible by e-mail. This will be to inform you of the correct price of the goods, and to ask you if you wish to continue with the order at the amended price, or to cancel the order altogether.  We reserve the right to vary product specifications.

These terms and conditions and all transactions relating to this online shop website are governed by English law and are subject to the non–exclusive jurisdiction of the English courts. We do not accept amendments to these terms and conditions

Liability – Our maximum liability for our failure to fulfil an order that we are legally bound to fulfil will be limited to the price paid by you for that order.

3. General Provisions

  • Residency – We only accept orders from and dispatch orders to addresses in Mainland UK including Scottish Highlands, Northern Ireland, Scottish Isles and Isle of Man.
  • Placing an order – It is your responsibility to check that your order is accurate before submitting it to us.
  • You can pay for Products using a debit card or credit card. We accept the following cards: Visa, MasterCard or American Express.

4. Pricing & VAT

All prices on this website are in pounds sterling. The price for each product will be shown without application of value added tax (VAT). We take care to ensure that all pricing information on our website is accurate but occasionally there may be an error. If you believe you have been charged the incorrect price, you should contact us and we will refund any overpayment.

VAT exemption – If you purchase an item for your personal use and you are chronically sick or disabled, or you are making the purchase on behalf of an individual who is chronically sick or disabled for their personal use, you may be entitled to purchase the item without having to pay VAT. You will be required to make a declaration to confirm that the VAT exempt status applies. It is your responsibility to give accurate information and to not make a false declaration.

5. Accuracy Of Information

We try to ensure that all information and colours are correct at the time of their publication. However, the representation of colours on your browser may differ from the actual colours of products supplied. Any typographical, clerical or other error is subject to correction without any liability on our part. Any advice or recommendation given on this website or otherwise given to you by us, or any of our employees or agents, is followed or acted upon entirely at your own risk and we are not liable for such advice or recommendation.

6. Postage & Packing Costs

Postage and packing costs will be added to the cost of your order and will depend on the total cost of the items you order, the size and weight of the items and, where delivery options are provided, the option you choose. The postage and packing charge you will pay will be displayed on screen before you confirm your order to us. Where multiple items are included in one order, we may dispatch the items separately, in which case, you will only be charged one postage and packing charge unless we state otherwise before you confirm your order.

7. Delivery

For next day delivery, and scooter/wheelchair deliveries, if the order is placed before 2:30pm Monday – Friday then the items will be sent on a next working day service. It is your responsibility to ensure clear access for delivery and we will not be liable for any damage caused by inadequate access. Delivery timescales are estimates only. If you do not receive your order within 10 working days of us confirming your order you should notify us, and we will investigate why you have not received your delivery.

If your item is being delivered using our courier delivery service, please note that items will only be delivered to the building’s main access door. It is your responsibility to ensure there is clear access for delivery of your item/s and we will not be liable for delayed deliveries due to inadequate access.

8. Notification Of Errors

You should check the content of each delivery promptly upon receipt. If you believe that items have been sent to you in error, you should contact us immediately.

9. Right To Cancel Order and Incorrect / Faulty Items

You have a statutory ‘cooling-off’ right, which entitles you to cancel your order within 14 working days of receipt of the goods in your order (certain exceptions apply). You also have rights in respect of items that are damaged on receipt or faulty. Details of these rights are set out below.

RETURNS POLICY

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations give you 14 calendar days from the date you received or collected your complete order to notify us of items you are not completely happy with. We must receive any item you return to us within 14 calendar days of your notification to us of your intention to return the item(s). Orders cancelled under these Regulations are entitled to a refund of any standard postage paid for the delivery of your order, but you are responsible for any postage incurred in returning the items you wish to cancel to us. Unfortunately, we do not refund postage on return of part orders.

Items must be returned in the condition you received them

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations give us the right to reduce the amount of refund that you receive, in the event that non-faulty items being returned are damaged or used in any way. The amount which we might reduce your refund by will be dependent on the decrease in value of your use of the item. You should note that should your use mean that your items cannot be resold, this reduction may be 100%.

Cancelled Items

Once we receive notice from you that you wish to cancel your order we will refund the purchase price for that item together with the packing and postage / delivery charge you paid to us for that item (if any).

If you wish to cancel an item after the cooling off period, provided you return the item to us within 14 days of the end of the cooling off period and in re-sellable condition we will refund the purchase price you paid for that item. We will not refund the packing and postage / delivery charge you paid to us for that item and you will have to pay the cost of returning the item to us.

Damaged and Faulty Items

If any item we have supplied is damaged on receipt or, within 6 months of supply, develops a fault, we will ask you to return the item to us for inspection. We will then replace or repair the item free of charge or refund the price you paid for it together with any packing and postage / delivery charges you paid to us for delivery of that item. You may have additional manufacturers’ warranties with some products giving you additional rights and you should check these carefully.

How to return items

For damaged and faulty items that you return to us we will provide a freepost address which will be of no cost to you.

10. Scooter / Wheelchair Warranty

All our scooters and wheelchairs come with a 12-month warranty as standard. In the unlikely event that you experience any issues with your new device, Des Gosling Mobility Ltd has a ‘Warranty Charter’ which covers both the scope of the warranty and the way in which any problems you encounter will be rectified. We go ‘above and beyond’ to ensure we keep you mobile and to ensure that all our processes are as easy as possible.

OUR WARRANTY CHARTER

We strive to ensure that you are always happy with your purchase and will respond speedily in the unlikely event that your product develops a fault during the warranty period in the following way: –

A Des Gosling Mobility Ltd staff member will contact you within two working days of us receiving a notification of a problem.

If your problem cannot be rectified over the phone, it will be necessary to return the equipment to our workshop for diagnostic and repair work to be carried out. If you live locally, the equipment can be brought back in person (which will speed up any repairs) or we can arrange collection by our Courier company. However, where this option is used it will be necessary for you to reuse the original packaging that the equipment was delivered in to protect it during shipping. (Please refer to our Shipping Policy)

We always aim to help in a constructive way and get you back on the road in the shortest possible time – we understand how important this is.

WARRANTY EXCLUSIONS

Our warranty does not extend to replacement of items due to normal wear and tear which includes any of the following:

  • Tyres
  • Light bulbs and fuses
  • Motor brushes
  • Seat upholstery and plastic shrouds
  • General wear and tear

Batteries are covered by a limited warranty for a period of 12 months subject to battery charging method being followed correctly as in the user instruction manual.

Any repairs or modifications not undertaken by an authorised engineer will also invalidate the manufacturer’s warranty. We do not permit the transfer of warranties to subsequent owners. The 12 Month Warranty will not cover the products if they have been misused, damaged or vandalised.
